1. Bu Politikanın Amacı
Bu Çerez Politikası, AKDil Güzelbahçe'nin web sitesinde çerezleri ve benzer teknolojileri nasıl kullandığını açıklar. 3. Çerezler Nedir?
Çerezler, bir web sitesinin ziyaretçinin tarayıcısına veya cihazına yerleştirdiği küçük metin dosyalarıdır. Çerezler, web sitesinin bir ziyarete ilişkin bilgileri hatırlamasını, talep edilen işlevleri sürdürmesini, web sitesinin nasıl kullanıldığını anlamasını ve ziyaretçinin gerekli izni verdiği durumlarda analiz, kişiselleştirme veya pazarlama faaliyetlerini desteklemesini sağlar.
Benzer teknolojiler arasında pikseller, etiketler, yerel depolama, yazılım geliştirme kitleri ve bir cihazdaki bilgileri okuyan veya saklayan ya da bir web sitesiyle gerçekleştirilen etkileşimleri izleyen diğer teknolojiler bulunabilir. Bu Politikada çerezler ve benzer teknolojiler birlikte “çerezler” olarak adlandırılmaktadır.
Çerezler, AKDil tarafından veya AKDil adına hareket eden bir hizmet sağlayıcı tarafından yerleştirilen birinci taraf çerezleri ya da web sitesine entegre edilmiş bir üçüncü taraf hizmeti tarafından yerleştirilen üçüncü taraf çerezleri olabilir.
4. Kullanabileceğimiz Çerez Kategorileri
Web sitesi aşağıdaki kategorileri kullanabilir. Çerezlerin kesin adları, sağlayıcıları, amaçları ve saklama süreleri web sitesinin güncel teknik yapılandırmasına bağlıdır ve sitenin çerez envanteri aracılığıyla doğrulanmalıdır.

Bu çerezler sayfa ziyaretlerini, trafik kaynaklarını, tarayıcı ve cihaz bilgilerini, sayfalarda geçirilen süreyi ve genel web sitesi kullanım eğilimlerini anlamamıza yardımcı olur. Böylece web sitesi performansını değerlendirebilir ve geliştirebiliriz.

Çerez bilgileri, yalnızca belirtilen bir amaç için gerekli olduğu ve yürürlükteki mevzuat tarafından izin verildiği durumlarda diğer bilgilerle birleştirilebilir. Çocukları tanımlamak veya çocuklar hakkında profil oluşturmak amacıyla çerez kullanmayı planlamıyoruz. Kayıt, iletişim, ödeme veya diğer formlar aracılığıyla gönderilen bilgiler Gizlilik Politikası ve verilerin toplandığı sırada sunulan ilgili aydınlatma metni kapsamında değerlendirilir.
6. Çerezleri Kullanma Amaçlarımız
Kesinlikle gerekli çerezleri web sitesini sunmak ve güvenliğini sağlamak, çerez tercihlerini hatırlamak, oturumları sürdürmek, kötüye kullanımı önlemek ve ziyaretçi tarafından talep edilen işlevleri sunmak amacıyla kullanırız.
Ziyaretçinin gerekli izni vermesi hâlinde; web sitesi trafiğini ve kullanım eğilimlerini ölçmek, teknik sorunları tespit etmek, web sitesi içeriğini ve işlevselliğini geliştirmek ve web sitesinin etkinliğini değerlendirmek amacıyla analiz çerezleri kullanabiliriz. Web sitesi, performans analizi için Google Analytics kullanabilir. Google Analytics ayarları, doğrudan kimlik belirleyici bilgilerin bu hizmete gönderilmemesini sağlayacak şekilde yapılandırılmalı ve gözden geçirilmelidir.
Ziyaretçinin açık rıza vermesi hâlinde pazarlama çerezleri, tanıtım faaliyetlerinin ölçümlenmesi veya ziyaretçiye daha uygun içerik ve reklamlar sunulması amacıyla kullanılabilir. Pazarlama çerezleri varsayılan olarak etkinleştirilmeyecektir.
7. Hukuki Sebepler ve Rıza
Kesinlikle gerekli çerezler aracılığıyla kişisel verilerin işlenmesi, çerez web sitesinin düzgün çalışması veya ziyaretçi tarafından özel olarak talep edilen bir hizmetin sunulması için gerekli olduğunda, KVKK'nın 5. maddesi kapsamında geçerli bir işleme şartına dayanabilir.
Zorunlu olmayan işlevsel, analiz, performans, reklam veya pazarlama çerezleri bakımından, kullanımlarına izin veren başka bir geçerli hukuki sebep bulunmadığında açık rıza alırız. Rıza; bilgilendirilmiş, belirli, özgür iradeye dayalı olmalı ve olumlu bir eylemle açıklanmalıdır. Bu nedenle zorunlu olmayan çerezler, ziyaretçi aktif bir seçim yapana kadar varsayılan olarak etkin olmamalıdır.
Web sitesinin çerez bildirimi veya ayarlar paneli, farklı çerez kategorileri için ayrı seçenekler sunmalıdır. Ziyaretçi, temel web sitesine erişimi engellenmeden zorunlu olmayan çerezleri kabul edebilmeli, reddedebilmeli veya kategorileri ayrı ayrı yönetebilmelidir. Ancak belirli bir çerez, ziyaretçinin açıkça talep ettiği bir hizmet için objektif olarak gerekli ise bu durum farklı değerlendirilebilir.

Ziyaretçi rızasını geri çektikten sonra AKDil, ilgili zorunlu olmayan çerezleri etkinleştirmeyi durdurur ve teknik sınırlamalar ile yürürlükteki saklama yükümlülükleri saklı kalmak üzere bunları silmek veya devre dışı bırakmak için makul tedbirleri alır.
Ziyaretçiler ayrıca tarayıcı ayarları üzerinden çerezleri kontrol edebilir. Tarayıcı kontrolleri çerezleri engelleyebilir veya silebilir; ancak kesinlikle gerekli çerezlerin devre dışı bırakılması web sitesinin işlevselliğini etkileyebilir. Tarayıcı üzerinden silme işlemi, web sitesi tarafından tutulan rıza kaydını otomatik olarak geri çekmeyebilir. Bu nedenle ziyaretçiler, mümkün olduğunda web sitesindeki Çerez Ayarları kontrolünü de kullanmalıdır.
9. Üçüncü Taraf Hizmetleri ve Veri Aktarımları
Bazı web sitesi işlevleri barındırma, güvenlik, analiz, ödeme, iletişim veya web sitesi yönetimi sağlayıcıları gibi üçüncü taraf hizmet sağlayıcıları tarafından sunulabilir. Bu sağlayıcılar AKDil adına teknik bilgileri işleyebilir veya hizmetleri etkinleştirildiğinde kendi çerezlerini yerleştirebilir.
Web sitesi performans analizi için Google Analytics kullanabilir. Kullanılan çerezler, saklama süreleri ve yurt dışına yapılabilecek aktarımlar da dâhil olmak üzere Google Analytics'in kesin yapılandırması, bu Politika yayımlanmadan önce canlı web sitesindeki yapılandırmaya göre incelenmelidir.
Üçüncü taraf hizmetleri bilgileri Türkiye dışında işleyebilir. Kişisel verilerin yurt dışına aktarılması hâlinde AKDil, KVKK ve ilgili düzenlemeler kapsamında gerekli güvenlik tedbirlerini ve aktarım mekanizmasını uygular. Mevcut sağlayıcılar ve aktarım bilgileri web sitesinin çerez envanterinde ve gizlilik bildirimlerinde listelenmelidir.
Kişisel bilgileri üçüncü taraflara satmaz, takas etmez veya kiralamayız. Web sitesini işletmek, hizmetleri sunmak, güvenliği sağlamak, performansı analiz etmek veya yasal yükümlülüklere uymak için gerekli olduğunda bilgileri güvenilir hizmet sağlayıcılarla paylaşabiliriz.
10. Çerezlerin Saklama Süresi
Çerezler, tarayıcı oturumu sona erdiğinde silinen oturum çerezleri veya belirli bir süre boyunca ya da ziyaretçi tarafından silinene kadar cihazda kalan kalıcı çerezler olabilir.
Saklama süreleri çerezin amacına ve sağlayıcısına göre değişir. Gizlilik Politikasında, Google Analytics ile ilişkilendirilen analiz bilgilerinin 26 ay sonra otomatik olarak silineceği belirtilmektedir. Bu süre, mevcut Google Analytics yapılandırmasına göre doğrulanmalıdır. Bu Politikanın yayımlanacak son hâli, web sitesinde gerçekleştirilecek tarama sonucunda tespit edilen her çerezin gerçek saklama süresini içermelidir.
11. Çocukların Gizliliği
AKDil, ebeveyn veya vasi gözetimindeki çocuklara anaokulu hizmetleri sunar. Web sitesi esas olarak ebeveynler, vasiler ve diğer yetişkinler tarafından kullanılmak üzere tasarlanmıştır. Çocukların profilini oluşturmak veya çocukları reklamlarla hedeflemek amacıyla zorunlu olmayan çerezleri bilerek kullanmayız.
Bir çocukla ilgili bilgiler hakkında soruları olan ebeveynler ve vasiler, Bölüm 13'teki iletişim bilgilerini kullanarak AKDil ile iletişime geçebilir. Kayıt bilgileri, sağlık bilgileri, acil durum iletişim kişileri, fotoğraflar ve videoların işlenmesi bu Çerez Politikası kapsamında değil, Gizlilik Politikası ve geçerli rıza formları kapsamında ele alınır.
12. Veri Güvenliği
AKDil, web sitesi aracılığıyla işlenen kişisel verileri yetkisiz erişime, değiştirilmeye, açıklanmaya veya yok edilmeye karşı korumak için uygun teknik ve idari tedbirleri uygular. Bu tedbirler arasında güvenli SSL/TLS iletişimi, erişim kontrolleri, güvenlik güncellemeleri, personelin sınırlı erişimi ve güvenli depolama ile yedekleme prosedürleri bulunabilir.
İnternet üzerinden gerçekleştirilen hiçbir aktarımın veya depolama sisteminin tamamen güvenli olduğu garanti edilemez. Ziyaretçiler güncel tarayıcı ve cihazlar kullanmalı ve web sitesi üzerinden gereksiz kişisel veya sağlık bilgileri göndermemelidir.
13. KVKK Kapsamındaki Haklarınız
KVKK'da yer alan şart ve istisnalara tabi olmak üzere; kişisel verilerinizin işlenip işlenmediğini öğrenme, işlenmişse buna ilişkin bilgi talep etme, işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme, kişisel verilerinizin yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme, eksik veya yanlış işlenmiş verilerin düzeltilmesini isteme, yasal şartlar oluştuğunda verilerin silinmesini veya yok edilmesini isteme, düzeltme, silme veya yok etme işlemlerinin ilgili üçüncü kişilere bildirilmesini isteme, münhasıran otomatik sistemler vasıtasıyla analiz edilmesi sonucunda aleyhinize bir sonucun ortaya çıkmasına itiraz etme ve kanuna aykırı veri işleme nedeniyle zarara uğramanız hâlinde zararın giderilmesini talep etme haklarına sahip olabilirsiniz.
